These terms apply to this website and to the PublishMode beta provided by The Bearded Beanie, an independent developer referred to below as the creator. By downloading, installing or using PublishMode, you agree to these terms. If you use it for an organisation, you confirm that you have authority to accept these terms for that organisation.
If you do not agree, do not download, install or use the beta. Nothing in these terms excludes or limits mandatory consumer rights or other rights that cannot legally be waived.
PublishMode is pre-release software supplied for testing and creative use. It may contain bugs, crash, sound different after an update, use more resources than expected or fail to recall settings correctly in some hosts. Features, presets and compatibility may change while the beta is developed.
Keep backups of sessions and audio, save important work before changing versions, and test the beta before relying on it in a live, broadcast, deadline-critical or otherwise important workflow. Known issues, compatibility and installation guidance are published on the download and manual pages.
The creator gives you a limited and non-exclusive licence to install and use the beta on compatible devices that you own or control. You may use it to test, create, edit and render audio in personal, client and commercial projects. The licence is non-transferable except where applicable law gives a lawful acquirer a right to transfer a copy or licence.
PublishMode, its code, interface, documentation, presets, branding and related materials remain owned by the creator and applicable rights holders. The licence lets you use the software; it does not sell or transfer ownership of the software to you.
Unless the creator gives written permission, you may not:
- redistribute, upload, share, sell, rent, sublicense or make the plugin or installer available to another person;
- remove or alter copyright, branding or other rights notices;
- reverse engineer, decompile or attempt to extract source code, except where applicable law expressly permits it;
- bypass technical restrictions or use PublishMode in a way that is unlawful or infringes another person's rights.
These restrictions do not prevent a lawful user from making a backup copy where it is necessary for use, observing, studying or testing the program's functioning, correcting errors, or decompiling only to the extent legally permitted for interoperability. Any mandatory rights concerning lawful transfer or exhaustion also remain unaffected.
05Your recordings and output
You keep the rights you already have in recordings, sessions and audio created with PublishMode. The creator does not claim ownership of your input audio or rendered output merely because the plugin processed it.
You are responsible for having the rights needed for material you process and for checking that your output is suitable for its intended release, client, platform or broadcast specification.
Feedback is voluntary and genuinely useful. If you send a bug report, suggestion or other feedback, you allow the creator to use, reproduce, adapt and incorporate the feedback content to develop, test and document PublishMode without payment or an obligation to implement it.
This permission does not authorise publication of your identity or override data-protection law. Do not send confidential material, passwords, licence keys or personal information that is not needed for the report. Personal data submitted through the feedback form is handled as described on the privacy page.
07Updates, availability and support
The beta may be changed for specific valid reasons, including development and testing, security, changes to hosts or operating systems, legal requirements and operational availability. A non-essential change will not add a charge to an existing beta licence. Reasonable notice will be given where practical or legally required, but no final release date, uninterrupted availability or individual support response is promised.
Where consumer digital-content rules apply, the creator will provide and inform users about security and conformity updates for the period required by law. If a continuously supplied version is changed in a way that negatively affects access or use beyond a minor degree, any statutory rights to advance notice on a durable medium, termination or continued access to an unmodified version remain in force.
Older builds may stop being supported, and sessions created with one beta build may not behave identically in another. Keep the installer and backups you need for active work where your host and applicable law allow it.
The current PublishMode beta is supplied as a free direct download from this site. No account or checkout is required, and this website does not collect payment-card details.
If distribution changes to a paid, pay-what-you-want or external checkout model, these terms and the privacy notice will be updated before that flow is enabled. The order flow will identify the legal seller and provide all business, price, tax, payment, delivery, withdrawal, defect-right and complaint information required by applicable law.
09Warranty and responsibility
PublishMode is a beta, so no separate commercial warranty is given. The beta label and published compatibility information explain the product's current state, but do not remove statutory requirements for conformity, security, updates or fitness for an expressly accepted purpose. Any disclaimer or limitation applies only to the extent permitted by applicable law.
Nothing in these terms limits mandatory remedies for defective digital content or excludes liability that cannot legally be excluded. Users should take reasonable steps to limit foreseeable loss, including keeping project and audio backups. Responsibility for a particular loss, including any contribution by the user, will be determined under applicable law.
You may stop using PublishMode at any time by uninstalling it and deleting copies you control. The licence may end if you materially breach these terms and do not correct the breach after notice where correction is appropriate. If the licence ends, stop using and distributing any copies of the software.
Terms that logically need to continue, including ownership, feedback permissions and responsibility for earlier use, continue after the licence ends. Mandatory rights and remedies also continue where applicable.
11External services and privacy
The current beta download is hosted directly on this site. The site may still link to external resources, and their own terms and privacy notices apply when you use them. If a checkout is enabled later, the legal seller must be identified in that checkout.
The creator is not responsible for an external service beyond any responsibility imposed by applicable law. An external provider's terms do not replace this software licence or the mandatory rights applicable to the transaction.
The site's privacy page explains the current approach to analytics, server logs, payments and feedback.
12Consumer complaints and dispute resolution
Please first send a written complaint to the legal seller identified in the checkout or order confirmation and allow a reasonable opportunity to respond. For software-only questions or a free beta with no checkout, contact the creator through the feedback form.
If Finnish consumer rules apply, consumers may obtain guidance from the Finnish Competition and Consumer Authority's Consumer Advisory Services. If the dispute is not resolved, a consumer may refer it to the Finnish Consumer Disputes Board, subject to that body's jurisdiction and process. This does not prevent either side from using a competent court or another dispute process available by law.
13Changes and general terms
These terms may be updated as PublishMode, its distribution or legal requirements change. The latest version and update date will be published here. Material changes apply prospectively, do not retroactively reduce accrued rights and will be communicated where reasonably practical or legally required; any consent required by law will be requested separately.
If a term is found invalid or unenforceable, it will be limited or removed only as much as necessary, and the remaining terms will continue. These terms do not prevent either side from using any court, consumer authority or dispute process available under applicable law.
